These terms govern your use of Sentiko. They are written to be read, not buried. Please take a minute with them.
These terms apply to every Sentiko surface, including the consumer app at sentiko.app, the about page at about.sentiko.app, the B2B landing at sentiko.org, and tenant dashboards at [client].sentiko.art (together, the "Service").
The Service is operated by Markevitch Media GmbH, trading as ikono, registered in Germany. Contact: hello@sentiko.app.
By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
Sentiko is an emotional barometer for cultural experiences. Visitors scan a QR code at a venue, an exhibition, a cinema, a streaming platform, a festival, and log how the experience made them feel. Cultural institutions receive aggregated, non-identifying emotional signals that help them understand how their programme lands.
The Service is provided as is, as an evolving product. Features may change, expand, or retire. We will not remove core functionality without reasonable notice where you rely on it through an account.
Anonymous use. You can scan a Sentiko QR code and log an emotion without creating an account and without providing any personal information. This is the default, and it is fully functional.
Account use. You may optionally create an account to keep a private garden of your reactions over time. Accounts are created by signing in through a supported provider (for example Google or Apple). You are responsible for keeping your sign-in credentials with that provider secure. You may delete your account at any time from within the Service or by writing to us.
Sentiko is a quiet tool. We ask you to use it in keeping with its spirit.
We may suspend or terminate access for serious or repeated breaches, with a preference for giving you a chance to correct course first.
The Sentiko name, the Sentiko word mark, the logo, the design system, the source code, the documentation, and the QR campaign assets are the property of Markevitch Media GmbH and are protected by applicable intellectual property laws. Nothing in these terms transfers ownership to you. You receive a limited, non-exclusive, non-transferable right to use the Service as offered.
Your individual emotional responses belong to you. Aggregated, non-identifying patterns derived from responses collected across visitors belong to the venue that hosts the experience and, where applicable, to Markevitch Media GmbH, for the purpose of operating and improving the Service. This split is described in more detail in the Privacy Policy.
Sentiko relies on third-party infrastructure, including Firebase (Google), Sign in with Apple, and Vercel. Your use of those providers' features (for example signing in with Google) is also subject to their own terms. We choose providers carefully, but we are not responsible for the independent acts of third parties.
Cultural institutions that deploy Sentiko (for example on a subdomain at [client].sentiko.art) do so under a separate agreement with Markevitch Media GmbH. As a visitor, your relationship is with Markevitch Media GmbH under these terms and under the Privacy Policy. Venues do not receive your identity, only aggregated emotional patterns.
We aim for the Service to be available whenever you need it, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, roll out updates, or take parts of the Service offline temporarily. Where feasible, we give notice.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Sentiko is not a medical, therapeutic, or diagnostic product. Nothing in the Service constitutes medical advice or clinical care.
To the fullest extent permitted by German law, our aggregate liability to you arising out of or in connection with the Service is limited to foreseeable damages typical for this kind of contract. We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, and where mandatory statutory liability applies (for example under the German Product Liability Act). For slight negligence, our liability is limited to breaches of material contractual obligations and capped at foreseeable typical damages.
Nothing in these terms limits consumer rights that cannot be excluded under the mandatory law of your place of habitual residence.
We may update these terms from time to time. When we do, we will post the revised version at this URL and update the version number and date at the top. If a change materially affects your rights, we will provide reasonable notice, for example through the app or by email to account holders. Continued use of the Service after an update means you accept the updated terms.
You may stop using the Service at any time, and if you have an account, you may delete it at any time. We may suspend or terminate your access where you materially breach these terms or where we are required to do so by law. Sections that by their nature survive termination (intellectual property, disclaimers, liability, governing law) will continue to apply.
These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes with merchants, legal persons under public law, or special funds under public law is Berlin, Germany. Where you are a consumer with habitual residence in the European Union, you retain the protection of the mandatory provisions of your local law, and you may bring proceedings in the courts of your place of residence.
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution procedures before a consumer arbitration board and, as of the date above, do not do so.
